9th Circ. Ruling Evinces Tightening Of Nonmedical Hardship

Asylum Law is changing. Even if you qualify, new procedures and agreements may impact your case.

A recent decision by the U.S. Court of Appeals for the Ninth Circuit is raising the bar for how hardship is evaluated in certain immigration cases, especially when that hardship is not strictly medical.

For many families, the emotional, psychological, and developmental impact of separation is very real but this ruling suggests that proving those factors may now be more difficult in court.

Understanding how these changes affect your case is critical.

Visa Update: New $15,000 Requirement for Certain Travelers Starting April 2

Beginning April 2, 2026, a new U.S. visa policy could impact travelers from dozens of countries.

Under an expanded visa bond program from the U.S. Department of State, some B1/B2 (tourist and business) visa applicants may be required to post a refundable bond of $5,000 to $15,000.

This update adds more countries to the program—bringing the total to around 50—and is intended to reduce visa overstays. The bond is typically refunded if travelers comply with visa terms and depart on time.

What this means:

  • Higher upfront costs

  • Increased scrutiny during the visa process

  • Greater importance of compliance

As policies continue to evolve, staying informed is essential. If you may be affected, understanding your options is key.

Client Success Stories

At Konare Law, every case is about helping families find stability and peace of mind. Attorney Namuun Byambadorj recently achieved two important outcomes for clients.

  • SIJS & Custody Success – Namuun successfully represented a mother in securing sole legal and physical custodyof her two children, along with Special Immigrant Juvenile Status (SIJS) findings. Despite jurisdictional challenges and a time-sensitive situation, the court granted emergency jurisdiction and approved all custody and SIJS orders—providing critical protection and a path forward for the children.

  • Positive ICE Check-In Outcome – In another case, Namuun accompanied a client to a scheduled ICE check-in in Baltimore. With strong legal preparation and compelling documentation, the client was not detained and was instead issued a follow-up check-in for the following year—allowing her to return home safely to her family.
