Marriage Does Not Automatically Stop Deportation

Marriage to a U.S. citizen may create a pathway to lawful status, but it does not provide immediate immigration status or automatically stop removal proceedings.

The available options depend on several factors, including how someone entered the United States, their immigration history, and whether they have a prior removal order. Understanding these details before filing can help prevent unexpected complications.

Public Charge Rule Changes Begin September 18

Beginning September 18, 2026, a new public-charge framework will apply to certain applications for admission and adjustment of status. Immigration officers will have broader discretion to consider an applicant’s overall circumstances, including financial resources, health, family situation, education, skills, and the receipt of certain means-tested public benefits.

Public charge does not apply to everyone, and the effect of the rule depends on the application and individual circumstances. Guidance may continue to develop before implementation.

Small Filing Mistakes Can Create Serious Delays

A missing signature, outdated form edition, incorrect fee, or incomplete application can cause USCIS to reject a filing. Missing supporting evidence may also result in delays, requests for additional evidence, or denial.

Before submitting an application:

  • Review every page carefully.
  • Include all required signatures.
  • Confirm that you are using the current form edition.
  • Verify the filing fee and supporting documents.
  • Keep a complete copy of everything submitted.
